Some silly things get patented, such as the method patent issued for using a laser pointer to play with your cat. But in recent years, questions have been raised as to whether companies should be able to patent software and certain technological methods of doing things.
The whole open source software movement, which brought us Linux and spawned Red Hat, among many other firms, has been one result of questioning the value of software patents.
Patent trolls, firms that create nothing but buy patents solely to seek license fees from other companies are also a growing problem.
On the other hand, obtaining patent protection for innovations is one way both start-up companies and established ones build value.

When a federal jury ruled against Google last week, awarding Bedrock Computer Technologies Inc. $5 million for infringement of a Linux kernel patent, it stirred up fears that the decision could have implications for other Linux users and Google’s much-sued Android mobile device operating system.
While Bedrock got no where near the $180 million it asked for in its suit against Google in the Eastern District of Texas federal court, it is cause for worry to other Linux users. Bedrock has also sued Amazon, MySpace, PayPal, Yahoo, AOL, and others, while Raleigh-based Red Hat, a Linux distributor, is suing Bedrock in an attempt to invalidate its patent. The Linux kernel is at the heart of Google servers and its Android OS is also built on Linux.
The patent in suit is: U.S. Patent No. 5,893,120, on “methods and apparatus for information storage and retrival using a hashing technique with external chaining and on-the-fly removal of expired data.”
In a statement, Google responded to the court decision, saying, “”Google will continue to defend against attacks like this one on the open source community. The recent explosion in patent litigation is turning the world’s information highway into a toll road, forcing companies to spend millions and millions of dollars defending old, questionable patent claims.”
Google’s Linux-based Andoid OS faces 14 other patent suits even as it has rapidly become the leading smartphone operating system.
This case and others – such as Apple Inc.’s against Samsung Electronics that claims Samsung copied iPad and iPhone designs – point up the need for some sort of patent reform when it comes to software.
Following the verdict in the Texas case, some analysts suggest others being sued may elect to pay fees rather than go to court.

RALEIGH, NC – Red Hat, the major seller of Linux open source software, says it will keep its headquarters in Wake County and add more than 500 jobs over the next five years. The company currently employs about 700 people at its headquarters at North Carolina’s Centennial Campus.
North Carolina awarded Red Hat nearly $15 million in incentives for its two-tiered expansion.
The company will invedst $109 million in new headquarters in Wake County of 300,000 to 4000,000 square feet and add 540 jobs – 240 in the next four years and 300 in 2015 as it introduces new products.
Companies have to meet hiring goals to receive the full amounts of Job Development Investment Grants from the state.
Red Hat has not yet selected the site for its expansion, but said it will be in Wake County.
The company has acknowledged considering sites in Austin, Texas, Atlanta, Boston, and in nearby Durham, NC.

DURHAM, NC – Rumors about the possibility of Raleigh-based Red Hat (NYSE:RHT) moving its headquarters have persisted throughout 2010 and may be resolved next year, if talk on the street is correct.
Talk of moving the Linux software developer to the West Coast has been one rumor that former executives confirmed earlier this year never ceased to be discussed within the company.
Now, while the company has made no secret of needing larger digs than its current space at North Carolina State University’s Centennial Campus in Raleigh, rumors suggest the company may be considering a move to Durham.
Much of the Research Triangle Park itself is in Durham, but a space there would be isolated from amenities just as the Centennial Campus is. Many RTP firms decry the lack of choice in restaurants or even a place to drop off dry cleaning and have for years. Still, the company could probably find the increased room it needs there and address remains prestigious.
Durham, on the other hand, has a flourishing tech community centered around the American Tobacco Campus that includes the recently opened American Underground, now home to CED and a number of start-ups, as well as some larger tech tenants.
Of course, Red Hat would want a much larger space – as much as 300,000 square feet, some say – but even being near the ATC would add to the collegial atmosphere of a more tightly knit tech community.
That seems to be the new paradigm for many technology centered parks these days, which are as likely to spring up in a downtown area of a city as in some dedicated industrial site.
The Piedmont Triad Research Park in Winston Salem, NC, and the North Carolina Research Campus in Kannapolis, NC, both life sciences oriented, were built on that new model of a community, not just an industrial park.
Rick Smith over at WRAL’s Local Tech Wire, has suggested the possibility of a Red Hat move to Durham. Capitol Broadcasting Co., owner of WRAL, is also an owner of The American Tobacco Campus.

RALEIGH, NC – Raleigh-based Red Hat Inc. (NYSE: RHT), a provider of open source solutions, has acquired Makara, a developer of deployment and management solutions for applications in the cloud. Makara’s technologies will accelerate the development of Red Hat’s comprehensive Platform-as-a-Service (PaaS) solution as part of its Cloud Foundations portfolio. Financial details of the transaction were not disclosed.
Based in Redwood City, CA, Makara provides solutions to enable organizations to deploy, manage, monitor and scale their applications on both private or public clouds. Customers facing issues in moving applications to the cloud and managing them efficiently can benefit from Makara’s solutions for scaling, rightsizing, rollback and monitoring.
By integrating the JBoss Enterprise Middleware infrastructure with Makara’s Cloud Application Platform, Red Hat can offer a more comprehensive PaaS solution that allows organizations to quickly transition their applications to both public and private clouds with minimal modifications.
“PaaS is becoming another market for software vendors looking to deliver compelling enterprise solutions in the cloud,” said Rachel Chalmers, research director at the 451 Group. “By acquiring the cloud technologies developed by Makara, Red Hat is now in a position to address this market by creating solutions for enterprises looking for deployment, management and auto-scaling capabilities to be baked into the core platform.”

RALEIGH, NC – North Carolina State University, in partnership with Southern Capitol Ventures, a North Carolina-based early-stage venture capital firm, is expanding a program launched three years ago to showcase some of Research Triangle Park’s biggest technology success stories to students in NC State’s Entrepreneurship Initiative .
The expanded program will now include students from other regional universities including Duke University and the University of North Carolina at Chapel Hill. The goal is to have students benefit from the exposure to all the companies they meet and begin to collaborate on their own ventures.
The next event will be held on October 22, 2010, with approximately 20 students from three universities participating.

DURHAM, NC – Zift Solutions, a ca SaaS company that increases channel sales by enabling channel partners to create and execute measurably better marketing campaigns, has extended its A round to $1.5 million. The company added Kinetic Ventures as an investor in addition to Southern Capitol Ventures, which invested $500,000 in June.
Jake Tarr, Kinetic Ventures managing director, joins the Zift board.
The company has also moved its headquarters from Raleigh to Durham, NC.
Founded in 2006, Zift provides a SaaS solution that allows clients to cost effectively deliver branded multi-channel marketing that includes online advertising, content syndication, SEO optimization, event management and e-mail marketing to channel partners.
The content can be created once and used by all channel partners on demand. The channel partners are provided easy access to the marketing programs, which are customized to reflect their unique branding. All partners can view their dashboard which measures each marketing campaign’s effectiveness and provide other key metrics.
“Companies like Red Hat use them to allow their partners to log in and customize Red Hat content, add their own contact information and logo and send it out,” explains Caplain.
“We look forward to working with the seasoned management team at Zift Solutions,” said Caplain. “As a repeat team, their technology and operational expertise has helped them scale the company quickly and surge ahead of their competitors.”
The Zift team has experience in delivering web-based enterprise marketing solutions to American Express, Target, National Geographic, AOL, Novartis, and to top agencies like Leo Burnett and Carmichael Lynch.
At the time of the initial funding, Jason Caplain, general partner of Southern Capitol Ventures told us, “Companies like Red Hat use them to allow their partners to log in and customize Red Hat content, add their own contact information and logo and send it out.”
He also said he thinks the firm has “One of the best management teams in the Triangle.”
